Business Finance Coaching - Terms of Use

These Terms and Conditions (“Terms”) govern the provision of business finance coaching services (“Coaching Services”) by Yasmine Shah (“Coach,” “we,” “us,” “our”) to you (“Client,” “you,” “your”).
By engaging our Coaching Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1. Services Provided
1.1 Scope of Coaching Services
Our Coaching Services include:
- Business financial capability development
- Strategic planning and goal-setting support
- Cash flow management education
- Financial report interpretation training
- Coordination support for your financial team
- General business finance education
- Access to templates, tools, and resources
1.2 What Coaching Services Do Not Include
Coaching Services explicitly do not include:
- Credit assistance or finance broking services
- Specific loan applications or lender submissions
- Personal financial product advice
- Accounting, bookkeeping, or tax services
- Legal advice or document preparation
- Preparation of financial statements
- Life coaching or personal development services
- Specific recommendations about any lender or loan product
2. Separation from Finance Broking Services
2.1 Distinct Services
Important: Business coaching services are completely separate from finance broking and credit assistance services.
- We are not acting as your finance broker or credit representative
- We are not providing credit assistance under the Australian Credit Licence held by QED Credit Services Pty Ltd
- Our Best Interests Duty as finance brokers does not apply to Coaching Services
- Different terms, conditions, and obligations apply
2.2 Credit Assistance Requires Separate Engagement
If you require credit assistance (for example, help with loan applications or refinancing), these services must be provided separately under finance broking terms. This means:
- You will receive a Credit Guide
- Our Best Interests Duty applies
- Different fees and processes apply
- Formal ASIC RG 273 obligations are followed
2.3 Transition Between Services
If during Coaching Services you identify a need for credit assistance:
- We will clearly explain the transition to finance broking services
- You will receive a Credit Guide before any credit assistance
- Separate terms will apply
- We will clarify which service is being provided at all times
3. No Advice Provided
- Not Financial Advice: Coaching is educational only. We are not licensed financial advisers.
- Not Accounting or Tax Advice: We are not accountants or tax agents.
- Not Legal Advice: We are not lawyers.
All information is general and educational in nature and should not replace professional advice.
4. Session Structure & Fees
- Sessions: 60 minutes via video call
- Minimum commitment: 4 sessions
- Fee: $250 + GST per session
- Invoiced monthly in advance; payment due within 7 days
- Payments accepted via bank transfer or card
Coaching fees are separate from finance broking services and non-refundable for completed sessions.
5. Cancellations & Rescheduling
- 48 hours’ notice required to cancel or reschedule
- Late cancellations or no-shows incur the full session fee
- Prepaid sessions valid for six months
6. Client Responsibilities
- Provide accurate business information
- Maintain relationships with accountants, lawyers, and advisers
- Implement strategies independently
- Acknowledge that results depend on your own actions
7. Confidentiality & Privacy
All information shared during coaching is kept confidential, except where disclosure is required by law or authorised by you. Your information is handled in accordance with our Privacy Policy.
8. Limitations & Disclaimers
- No guarantees of business success, revenue, or loan outcomes
- Information is based on your circumstances at the time of coaching
- We are not responsible for third-party information or tools
9. Limitation of Liability
Our liability is limited to the total coaching fees paid in the 12 months preceding any claim. We are not liable for indirect, consequential, or financial losses.
10. Intellectual Property
All templates and materials remain our property. You may use them for your own business but not reproduce or distribute them.
11. Termination
Either party may terminate coaching by written notice. Completed sessions are non-refundable. Prepaid sessions will be refunded pro-rata.
12. Complaints & Dispute Resolution
If you have concerns about our Coaching Services:

- We will acknowledge within 1 business day
- We aim to resolve within 30 days
Complaints about finance broking should follow the process outlined in our Credit Guide.
13. Modifications to Terms
We may update these Terms at any time. Updates will be posted on our website and apply to future sessions.
14. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Disputes will be handled in NSW courts.
15. General Provisions
- These Terms and our Privacy Policy form the entire agreement
- If a clause is invalid, the rest remain effective
- Failure to enforce any term is not a waiver
- We may assign our rights under these Terms
16. Acknowledgements
- You understand coaching is separate from finance broking
- No credit, financial, accounting, or legal advice is provided
- Our Best Interests Duty does not apply to coaching
- Coaching does not guarantee results
